WEDDING PHOTOGRAPHY CONTRACT AGREEMENT

Contract Agreement
The person(s) whose name(s) appears on this contract known as "client" agrees that Alyx DEE (GARDNER) known as "vendor" shall provide services to photograph their wedding and wedding day events. This is a binding contract, which includes the complete understanding of all parties involved.
Payments
A non-refundable retainer fee of $500 must be made at the time of booking. The second non-refundable RETAINER FEE OF $500 must be made at least three months prior to the scheduled wedding date.
Your remaining balance must be paid in full at least four weeks prior to your scheduled wedding date.
(*Please note that upon booking your wedding date - you will receive a payment deadline layout. You may also receive reminders for upcoming payment deadlines as they approach but it is ultimately your responsibility to make these payments as they are due.)
Further Expenses
Should there be any further expenses for the vendor(s) such as, but not limited to: travel fees, parking fees, venue/location fees, fees related to adventure-portrait sessions - Client will pay in full out of pocket for these expenses or services will not be provided.
Cancellations or Rescheduling
Should the Vendor need to cancel for any reason, including; but not limited to: serious personal illness/injuries, or serious illness or death within immediate family, please note that I will make every effort to provide a replacement for your day. I am active in my local photography community(s) and have several other reliable professionals that I can call upon if needed.
If the Client must cancel for any reason, unless otherwise agreed upon between the vendor and the Client, Client should not expect any refund or compensation of any kind for the payments that have been previously made. If any cancellations must be made due to uncontrollable circumstances such as; but not limited to: A GLOBAL PANDEMIC*, GOVERNMENT-MANDATED REGULATIONS OR RESTRICTIONS, flight cancellations or delays or unsafe weather conditions for traveling on either parties part, please note that a refund will not be made, unless otherwise agreed upon between the vendor and the Client.
Should the Client need to reschedule for any reason, vendor cannot guarantee that a specific date will be open and available for booking. All previously made payments can be applied, only to, a rescheduled event - with a rescheduling fee that will be discussed as needed. Should vendor not be available for rescheduling, you will not receive any refunds or compensation of any kind.
*PLEASE NOTE THAT ANY RESCHEDULED DATES DUE TO COVID-19 WILL NOT INCUR A RESCHEDULING FEE, SO LONG AS THE RESCHEDULED DATE IS OPEN AND AVAILABLE FOR BOOKING.
Additional Product Ordering
Vendor is not responsible for any prints or products that are not ordered directly through vendor.
use of images + copyright
client will have unlimited digital downloading, printing, and posting rights. All photographs taken by Vendor are and will remain the property of Alyx DEE (Gardner). Client herby waives any claim of ownership, financial compensation, and right to further edit or retouch images.
Meals
It is clients' option to provide a meal for the photographer(s) for ANY event LASTING six hours or longer. If no meal is provided, it is understood that the photographer(s) will take an appropriate 30 MINUTE break to obtain a meal.
*This break is usually taken while the COUPLE IS eating, WHICH HELPS TO ENSURE THAT NO KEY MOMENTS ARE MISSED.
Exclusive Professional Photographing
It is expected that friends and family members will have personal cameras present and will be taking lots of photoS. However, please understand that no one besides the hired and previously determined photographer(s) working with Alyx DEE, Photographer should be posing, moving, tweaking, and/or re-arranging contents of the photographs including; but not limited to: people and/or props during all formal photographY that takes place. Should there be an interference involving any person(s) other than the hired photographer(s) - the appropriate person will be notified, and it is expected to be handled accordingly. If the interference persists, the Photographer(s) will continue working and will not be held liable for the results of any and all interferences.
Image Editing/Retouching
Final edited images may include any of the following; but not limited to: black and white edited images, selective color images, and color-corrected images. Blemish removal and/or retouching are included at the vendor's discretion. Client may request further modifications to be made involving cropping or editing for an additional charge, however, the vendor does have the right to deny any additional editing requests if they cannot be made.
Client may NOT further edit or retouch images in any way. Client may NOT crop or alter images. Client may NOT add any filters to vendor’s photos that appear on any social media or anywhere on the internet.
(This includes Instagram, twitter, and Facebook filters.)
Further Use Of Images
Vendor will have the irrevocable right to use the photographs for, but not limited to: promotional posters, business cards, and advertisement on web pages and social networking sites, such as Facebook AND INSTAGRAM. Client will not receive compensation of any kind for the images used. Client will not have the right to inspect or approve the finished images that are used at the Vendor's discretion. Client waives any right to request the removal of photographs from any of the previously stated promotional websites, advertisements, etc.
*Please note that vendor and associates will be respectful of your privacy and will not use or post any photographs that tarnish the respect between the vendor and the Client.
Product Delivery
Final edited images can be expected to be delivered approximately 7-9 weeks after your ceremony date. A rushed GALLERY delivery may be requested and, if available at the time of request, a fee of $125 PER WEEK RUSHED will be charged.
